What Happens to Your Family if Your Permit Lapses

Family permits fall with the sponsor's. Your renewal deadline is the whole household's deadline.

Most people treat a residence permit renewal as an administrative task with a personal consequence. If you sponsored anyone, it is not. A family permit exists because of your status and for no other reason, so a deadline you miss is a deadline your spouse and your children miss with you, and they find out from your file rather than their own. Here is exactly what falls, what does not, and how to sequence renewals so the question never arises.

Derivative means exactly what it sounds like

A family residence permit is granted on a relationship to somebody who is lawfully here. The applicant does not show their own work, income or business, and that is the route's whole appeal. It is also its whole weakness: nothing in the file belongs to the applicant, so when the thing it rests on goes, there is nothing underneath.

That is a structural feature rather than a penalty, and it applies identically to a spouse, a minor child and, for permanent residents and citizens, a parent or adult child. The four ways a sponsor's status ends

The missed filing deadline. The most common, and the most avoidable. An application lodged inside the last 40 days of your lawful stay is refused review rather than refused on its merits, which means nobody assesses whether you would have qualified. Discretion exists where the card is still valid, and it is discretion rather than entitlement. Count backwards from the date printed on the card, not forwards from when you would like the new permit to start.

Refusal at renewal. Renewals are not rubber stamps and the evidence is re-tested. Circumstances change, income drops, an employer stops trading, and the file that worked last year does not work this year. Revocation before expiry. A permit can be withdrawn where the basis for it disappears: the property sold, the employment ended, the business closed. This is the one that catches households mid-cycle, because there is no diary entry for it. The grounds are set out in the guide to losing a Georgian residence permit.

Divorce, or the death of the sponsor. A permit resting on a marriage rests on the marriage continuing, so divorce removes the basis for the dependent spouse's permit, as covered in residence through marriage. One related question we are not going to answer, because nothing published answers it: whether permanent residence already granted as the spouse of a Georgian citizen survives a divorce or that spouse's death. The published rules do not squarely address it. If that is your position, take advice on your own facts rather than accepting reassurance in either direction, including ours.

The appeal will not hold the line for you

Two figures decide how much room a household has after a refusal, and both of them are tighter than people assume.

The appeal window is 10 calendar days. That is calendar days, running from the decision, and it does not wait for you to find a lawyer or return from a trip.

More importantly, since the 2025 amendments an appeal no longer suspends enforcement. Before that change, appealing bought time and the family's position held while the matter was considered. It does not now. A household planning on "we will appeal if it goes wrong" is planning on a mechanism that stopped doing that job.

Practically, this reverses the order in which a family should spend its effort. Almost all of it belongs in filing early and filing correctly. What is left over belongs in building an alternative basis, not in the appeal.

The number that matters

Count 40 days back from the expiry date on the sponsor's card and put that date in every calendar in the household. Everything on this page is about protecting that one date. A permit renewed on time cannot take anyone down with it.

Sequencing: the order that protects a household

Align every permit onto one cycle. A family that arrives in stages ends up with four permits on four expiry dates and four filing deadlines a year. That is four opportunities to miss one instead of one, and it multiplies the fee overhead as well. Where the arrival is staged anyway, it is usually worth filing a shorter first permit for somebody so that the next renewal brings everyone onto the same date.

File the sponsor first, or at least at the same time. A dependant's application has nothing to attach to until the sponsor's status is settled. Filing a spouse's renewal before your own is not efficiency, it is putting the derivative file in front of the file it derives from.

Buy the faster decision when the dates are tight. Government fees run from GEL 300, about $115, for a decision on the 30th calendar day, GEL 450, about $172, for the 20th, and GEL 600, about $230, for the 10th. Paying up a track is cheap next to a household losing status, and it is the correct response to a compressed timeline rather than an indulgence.

Diary the sponsor's date, not each person's. Everyone in the household is on the sponsor's clock whatever their own card says. What a dependant can do, and when

The honest answer is that the moment to act is while everybody still holds lawful status. Every route out of this is easier from inside Georgia with a valid card than from outside it without one.

Build an independent basis. A spouse who works can hold a work permit in their own right, which since 1 March 2026 also means a Special Labour Permit alongside it. A spouse with qualifying remote income can look at the IT residence permit, which at three years runs longer than most sponsors' permits do. A household with capital can put a qualifying purchase in the dependant's name and take a property residence permit from the other direction. Any of these converts a derivative permit into one that stands on its own.

Do it before it is urgent. All three routes have document chains measured in weeks and decisions measured in days, and none of them is available to somebody whose lawful stay has already ended. A family in trouble at the deadline has fewer options than the same family had three months earlier, and the difference is entirely one of timing.

The clock nobody thinks about

There is a second cost to a lapse that does not show up for years.

Permanent residence takes ten years of continuous temporary residence, or five for investment permit holders. Continuity is the operative word: a gap between permits resets the count to zero rather than pausing it, which is the subject of what breaks continuous residence. A household that loses status in year seven and re-establishes it three months later has not lost three months. It has lost seven years, for every person in the household, including the children who did nothing.

That is the strongest argument on this page for treating renewal as a household event, and it is the one people take least seriously because the consequence is so far away. The route to permanent residence is the only thing that eventually takes a family off the annual cycle altogether, and every lapse pushes it back to the beginning.

Renewing four people on one cycle is cheaper than renewing four people on four cycles, and the difference is not only fees: it is one set of accommodation and income evidence assembled once instead of four times a year. They end with yours. A family residence permit is derivative: it exists because of your status, so when that status ends there is no basis left for anyone attached to it. This applies to a spouse, minor children and any parent or adult child you sponsored as a permanent resident.
