You can be on a plane to Tbilisi tomorrow, and that part Americans get right. What goes wrong is the FBI Identity History Summary sitting in a federal queue while the filing deadline moves closer, and a tax position that follows you out of the country whatever Georgia decides about your permit. Georgia's side of this is the same for every foreign national. Yours differs in three places: the document chain, the exit, and the treaty position. Here is each of them.
Can you enter Georgia, and for how long?
Yes, for a full year at a time. The United States appears on the list annexed to the Georgian ordinance approving visa-free entry, which sets the permitted stay at one full year and was last amended on 24 February 2026. We checked that text on 1 August 2026, and it is the document Georgian border officers work from rather than any summary of it.
That single fact shapes everything else. Because you can be lawfully present for a year without asking anyone's permission, the sensible sequence is to land, assemble documents locally, and file at a Public Service Hall. Applying through a Georgian mission in the US is available and slower, and it removes your ability to fix a rejected document in person.
One condition now attaches to the entry itself. Every visitor must hold travel or health insurance with a minimum of GEL 30,000 in cover, and the 2026 insurance rule is checked at the border rather than at the permit stage. The year of visa-free stay is also resettable on re-entry, which tempts people into treating it as a permanent arrangement. It works, for as long as the border runs are tolerable, but it accrues nothing toward permanent residence and it is thin ground for a Georgian bank.
Which route actually fits an American
The routes, thresholds and government fees are identical on every passport. What differs for you is which of them costs the most calendar time, and the answer turns on one document.
Two routes ask for no home-country criminal record certificate: property and investment. That absence is worth more to an American than to almost anyone else, because it removes the FBI queue from the schedule entirely. If you qualify for the property route at $150,000, it is materially faster for you than it is on paper.
The work and IT routes carry the certificate, and they carry something else. Since 1 March 2026 the Special Labour Permit is a prerequisite rather than a parallel process, so a work residence permit filed before the labour permit is granted produces a refusal instead of a delay. Americans running a US company remotely often assume the labour permit is somebody else's problem. It is, right up until they want the card, and then it is the first thing in the file.
The IT residence permit fits a large slice of the American cohort in Tbilisi, at $25,000 of annual income and two years of experience for a three-year term. Read its 183-days-a-year presence condition carefully before choosing it. It is a real commitment to being in Georgia, and it does nothing at all to your US filing position.
Your document chain runs through two different apostille authorities
This is where American applications lose weeks, and the cause is always the same mistake: treating "the apostille" as one office.
Federal documents go to Washington. The FBI Identity History Summary is a federal record, and the US Department of State Office of Authentications is what apostilles it. Order the summary so that it arrives carrying the FBI's own watermark and the signature of a division official, because that signature is what the Department of State checks against its specimens. A copy produced without it is not apostillable.
State documents go to the state that issued them. Your birth certificate, your marriage certificate and any divorce decree are state records, and the apostille comes from the Secretary of State of that state. Several states want a county clerk or state registrar certification first, and a document issued in one state cannot be apostilled by another. An applicant born in Ohio and married in Nevada is running two separate errands.
The FBI publishes processing times that vary up to twelve weeks depending on volume, and electronic submission through the Identity History Summary service is faster than posting fingerprint cards. Add the Department of State leg after it, then a courier in each direction. Nothing in Georgia can shorten any of this, and no Georgian office can apostille American paper.
Translation is the last step and it happens here, not there. Apostille the original in the US, ship the paper original, then have it translated and notarised in Georgia. The full sequence and what gets rejected is set out separately, along with the police certificate procedures by country.
What the United States does when you leave
Nothing, and that is precisely the problem. There is no American exit tax on ordinary emigration, no deregistration to complete and no notification anyone expects. You simply keep filing.
The IRS position on citizens abroad is that you remain subject to tax on worldwide income from all sources wherever you live. Living in Tbilisi gives you an automatic two-month extension to 15 June, and access to the foreign earned income exclusion and the foreign tax credit, but both of those are claimed by filing a return, not by qualifying for them quietly. An American who stops filing because they have left has not solved anything.
Foreign account reporting is where people who did everything else correctly still trip. The threshold is measured across your accounts in aggregate rather than per account, so a Georgian current account, a savings account and a brokerage account that individually look trivial can cross it together. Open the Georgian bank account with that in mind rather than discovering it a year later.
There is one place where the exit becomes expensive, and it sits at the end of the Georgian path rather than the beginning. Georgia does not generally permit dual citizenship and expects renunciation, so an American who takes Georgian naturalisation to its conclusion is contemplating giving up US citizenship. That engages the expatriation regime at section 877A of the Internal Revenue Code, which marks a covered expatriate's property to market and requires Form 8854. The thresholds that decide who is covered are indexed annually, so check the figures for the year of expatriation rather than any figure you read earlier. Most Americans should stop at permanent residence, and the dual citizenship position explains why the endgame is decided on day one.
The treaty position, stated honestly
Georgia publishes its own network of double tax treaties, 58 of them in force, and the United States is not on that list. That is the fact the Georgian side works from.
The American side reads differently. The IRS treats Georgia as covered by the 1973 convention concluded with the Soviet Union, on the basis that Georgia is one of the former Soviet republics to which that instrument continues to apply. So there is a treaty the IRS will point to and no treaty Georgia's Ministry of Finance recognises as part of its network, which is not a comfortable place to plan from.
Practically, do not build a structure on a treaty benefit here. Assume relief from double taxation comes through the US foreign tax credit and take advice before relying on anything else. The wider question of which country may tax what, and why holding a permit is not the same as being taxed here, sits in the difference between a residence permit and tax residency and in the Georgian treaty network. Georgia's own test is a day count: 183 days in a rolling twelve-month window makes you tax resident here, and it operates whether or not you hold a permit.
Timeline and cost, realistically
Count backwards, not forwards. Georgian law requires the application to be filed at least 40 calendar days before your lawful stay expires, under the Law on the Legal Status of Aliens and Stateless Persons, and an application filed inside that window is refused review rather than assessed. On a work or IT route there is a second queue in front of it, because the labour permit has its own decision period.
For an American the practical trigger point is three to four months before the deadline, and the FBI summary is what sets it. Government fees are unchanged by nationality, and the full cost breakdown by route covers both the state fees and ours. The counting rule itself, and the narrow discretion that sometimes survives a late filing, is in the 40-day rule.
The verdict
Straightforward, with the difficulty entirely on the American side. Entry is free, the routes are open, and the Georgian process is one of the least obstructive in the region. Your two real problems are a federal document queue you cannot expedite and a tax citizenship you cannot leave behind, and both are managed by starting earlier than feels necessary.
Where it stops being a page-answerable question is the tax overlay: whether the exclusion or the credit serves you better, what the treaty gap means for your particular income, and whether the ten-year path to permanent residence or naturalisation is worth planning toward at all. That is what the free consultation is for, and half an hour on it beats a confident guess.
Thirty minutes to establish which route fits, what it costs, and whether you have enough time left on your current stay.

Key takeaways
- US citizens enter Georgia visa-free for one full year, verified against the Georgian visa-free ordinance on 1 August 2026.
- The FBI Identity History Summary is federal and is apostilled by the US Department of State. Birth and marriage certificates are apostilled by the state that issued them.
- FBI processing runs up to twelve weeks, so order it first and schedule everything else behind it.
- The property and investment routes need no criminal record certificate, which removes the slowest American document from the file.
- Since 1 March 2026 the Special Labour Permit comes before the work or IT residence permit, including for remote work invoiced to a US company.
- Georgia's treaty list does not include the United States. The IRS applies the 1973 USSR convention to Georgia, and the two positions do not match.
- Citizenship-based taxation continues wherever you live, and Georgian naturalisation would mean renunciation and the expatriation regime.
Frequently asked questions
Can US citizens enter Georgia without a visa?
Yes, for one full year at a time. The United States is on the list annexed to the Georgian ordinance on visa-free entry, checked on 1 August 2026, and the period resets when you leave and return. You still need travel or health insurance with at least GEL 30,000 of cover, which applies to every visitor from 2026.
Which police certificate does Georgia want from an American?
The FBI Identity History Summary, apostilled. A state or local police check is not the federal record and is routinely rejected for this purpose. Request it so it arrives with the FBI watermark and a division official's signature, because that is what the US Department of State authenticates when it issues the apostille.
Who apostilles an FBI background check for Georgia?
The US Department of State Office of Authentications, because the FBI summary is a federal document. This catches people out, since every other document in their file goes to a state Secretary of State. Send the federal record to Washington and the state records to the state that issued them, and expect two different queues.
Is there a US tax treaty with Georgia?
Georgia's Ministry of Finance lists 58 double tax treaties in force and the United States is not among them. The IRS takes a different view and treats Georgia as covered by the 1973 convention with the Soviet Union. Because the two sides do not agree, treat any treaty benefit as something to confirm with an adviser rather than assume.
Do Americans still pay US tax after getting a Georgian residence permit?
Yes. US citizens are taxed on worldwide income wherever they live, and no residence permit anywhere changes that. You get an automatic two-month filing extension to 15 June while abroad, and the foreign earned income exclusion and the foreign tax credit may reduce what you owe, but both have to be claimed on a filed return.
Which Georgian residence permit is best for a US citizen?
If you have the capital, the property route at $150,000, because it needs no FBI check and therefore no federal queue. If you have income instead, the IT permit suits remote technology workers at $25,000 a year and two years of experience, and the work permit suits everyone else. Both of those need a Special Labour Permit first.
Can an American work remotely from Georgia without a permit?
Yes. The Special Labour Permit is engaged by employing foreign staff in Georgia, by trading as an Individual Entrepreneur with Georgian clients, and by applying for a work or IT residence permit. Invoicing a US company from a Tbilisi apartment is none of those, and it can run indefinitely on visa-free entry. What changes the answer is wanting the residence card, or picking up a Georgian client.
How long does the whole process take for a US applicant?
Plan on three to four months from starting the FBI request to filing, and that is before the Georgian decision period. The FBI publishes turnarounds of up to twelve weeks depending on volume, then the Department of State apostille, then couriers in both directions. The Georgian steps that follow are the fast part.
Can a US citizen get Georgian citizenship?
In principle, after ten years of continuous residence and exams in Georgian language, history and law. In practice it is closed to most Americans, because Georgia does not generally permit dual citizenship and expects renunciation, and renouncing US citizenship triggers the section 877A expatriation regime. Permanent residence is the realistic destination.
Do I need to be in Georgia to apply for a residence permit?
Not strictly, but it is far easier. Americans can file through a Georgian diplomatic mission abroad, or through a representative under an apostilled power of attorney. Most people enter on the visa-free year and file in person, because a document queried at the counter can be corrected the same week rather than posted back across the Atlantic.
