Georgian Residence Permit for Spanish Citizens

Ask for the apostille inside the certificate request, not afterwards. Then watch the three-year nationality clock.

Spain gives you the fastest document chain in this cluster and the sharpest trap at the end of it. The certificate and its apostille come from the same ministry in a single request, which most applicants discover only after paying for two. And a Spaniard who eventually naturalises somewhere else has three years to say so in writing or the Spanish passport goes. Georgia's half of the process is identical on every passport; yours differs in those two places and in what the tax office wants when you tell it you have gone.

Can you enter Georgia, and for how long?

Yes, for one full year at a time. The Kingdom of Spain appears on the list annexed to the Georgian ordinance approving visa-free entry, which fixes the permitted stay at one full year and was last amended on 24 February 2026. We read that text on 1 August 2026, and it is the instrument Georgian border officers apply rather than any summary of it.

So nothing has to be arranged before you fly. Land, live here lawfully for a year, assemble the file and submit it at a Public Service Hall. Filing through a Georgian mission in Spain is possible and slower, and it removes your ability to correct a queried document at the counter the same week.

One condition attaches to the entry itself. From 2026 every visitor needs travel or health insurance carrying at least GEL 30,000 of cover, checked at the border under the 2026 insurance rule. And the year of visa-free stay is presence rather than status, so it accrues nothing toward permanent residence however many times you reset it.

Which route actually fits a Spanish applicant

Georgia's routes, thresholds and government fees do not move with your passport. What moves is how much calendar time your documents cost, and for a Spaniard that number is small.

The property route at $150,000 and the investment route at $300,000 need no home-country criminal record certificate. For most nationalities that is the decisive scheduling advantage. It is worth less to you, because your certificate is often issued the same day. Choose those routes for what they are rather than for speed you already have.

Everyone else lands on the work or IT routes, and since 1 March 2026 both sit behind a second permit. The Special Labour Permit is a prerequisite rather than a parallel filing, so a residence permit application submitted before the labour permit has been granted produces a refusal instead of a queue position. Spanish freelancers invoicing Madrid or Barcelona clients from a Tbilisi flat are inside that sequence too once they want the card. Foreign clients on their own engage no permit at all.

The IT residence permit fits a large share of the Spanish cohort here, at $25,000 of annual income, two years of experience and a three-year term. Its condition of 183 days a year in Georgia has a second use for a Spaniard, because it is the presence that makes a Georgian tax residency certificate obtainable, and that certificate is what the Spanish tax agency asks to see.

Your document chain is one request, not two

The certificate and the apostille travel together. The certificado de antecedentes penales is issued by the Ministry of Justice, requested through its electronic office with Cl@ve or in person at a Gerencia Territorial. The ministry's own service page is explicit about the international step: where the certificate is to be used abroad it has to be legalised, and you do that by selecting the apostille option inside the certificate request itself.

That is the whole trick, and it is the opposite of the German arrangement where the apostille has to be applied for before the certificate exists. Arranging a Spanish apostille as a separate errand afterwards means a second procedure for something the first one would have done.

Timing. The ministry states that the certificate is normally issued at the moment, or within 24 hours where immediate issue is not possible, with a maximum of 10 working days, and up to 30 calendar days for EU citizens where records have to be gathered from other member states. Those are the figures published by the issuing authority, and they are the ones to plan against rather than anything quoted second hand.

Civil documents. Birth and marriage records come from the Registro Civil, and what Georgia wants is a full certified extract rather than a family book. Each original needs its own apostille, and the full apostille sequence and the police certificate procedures by country set out what actually gets rejected.

Translation happens in Georgia, on the paper original, after the apostille is attached. A translation prepared in Spain is itself a Spanish document and needs its own authentication, so translating early usually means paying twice.

What Spain does when you leave

Modelo 030, and the certificate it asks for. A change of tax domicile is communicated to the Agencia Tributaria on Modelo 030, and the AEAT's guidance on communicating a change of tax domicile requires the change to be notified within three months. Where the new domicile is abroad, the supporting document is a tax residency certificate issued by the tax authority of the country you have moved to.

That single requirement links the two halves of this guide. A Georgian tax residency certificate is issued on the strength of presence here, so a Spaniard who leaves in March cannot produce one in April. Plan the notification around when the certificate becomes obtainable, and understand that filing Modelo 030 is a notification rather than a ruling: Spain still decides residence on its own tests, and the gap between holding a permit and being tax resident is the most expensive misunderstanding in this niche. Georgia's own test is 183 days in a rolling twelve-month window.

The quarantine that does not apply. Article 8.2 of the personal income tax law keeps Spanish nationals inside the Spanish tax net for the year of the move and the four following tax periods where they relocate to a country classified as a non-cooperative jurisdiction. That list is set by ministerial order, and the order in force, as amended with effect from 28 June 2026, does not include Georgia. So the five-year quarantine is not your problem. Spain's ordinary residence tests still are.

The nationality trap, and the treaty

Spain is one of the few origins in this cluster where the home country, not Georgia, can withdraw your passport.

Under article 24 of the Código Civil, an emancipated Spaniard habitually resident abroad who voluntarily acquires another nationality loses Spanish nationality once three years have passed from that acquisition. The loss is avoidable: within those three years you declare to the officer of the Civil Registry that you wish to keep Spanish nationality. The exemption for Ibero-American countries, Andorra, the Philippines, Equatorial Guinea and Portugal does not cover Georgia, so the declaration is the only thing standing between you and the loss.

In practice that question rarely arrives, because Georgia does not generally permit dual citizenship and expects renunciation, with an exception granted by presidential decree on state-interest grounds. The dual citizenship position decides the endgame long before article 24 matters, and permanent residence at ten years carries no renunciation on either side.

Timeline and cost, realistically

Count backwards. Georgian law requires the application to be filed at least 40 calendar days before your lawful stay expires, and anything filed inside that window is refused review rather than assessed. On a work or IT route the labour permit decision sits in front of that again.

For a Spanish applicant the trigger point is around two months out, because the certificate and its apostille are one step and often a fast one. The verdict

Straightforward. One ministry, one request, a treaty in force since 2011 and no non-cooperative-jurisdiction quarantine to worry about. Very little about being Spanish makes a Georgian residence permit harder.

The two things worth taking seriously are administrative rather than legal. Do not treat the apostille as a separate errand, and do not treat Modelo 030 as something you file on the way to the airport, because the certificate it asks for does not exist until you have been here.
